PenPage Terms of Service

Welcome to PenPage
These Terms of Service ("Terms") govern your use of PenPage (the "Service"), a privacy-first
note-taking application accessible at penpage.com. By using PenPage, you agree to these Terms.
If you don't agree, please don't use the Service.
1. Acceptance of Terms
By accessing or using PenPage, you confirm that:
- You are at least 13 years old (or the age of digital consent in your country)
- You have the legal capacity to enter into these Terms
- You will use the Service in compliance with all applicable laws
- You agree to our Privacy Policy
2. Description of Service
PenPage is a web-based note-taking application that:
- Stores your notes locally in your browser by default (using IndexedDB)
- Optionally syncs your notes to your personal Google Drive account
- Allows you to create, edit, organize, and export notes in Markdown format
- Provides a WYSIWYG (What You See Is What You Get) and Markdown editor
- Works offline without requiring an account or login
3. Your Use of PenPage
3.1 Permitted Use
You may use PenPage for:
- Personal note-taking, journaling, and idea capture
- Professional documentation and writing
- Educational purposes and research notes
- Any lawful purpose that respects these Terms
3.2 Prohibited Use
You agree NOT to:
- Use PenPage for any illegal activities or to store illegal content
- Attempt to hack, reverse-engineer, or compromise the Service
- Use automated tools (bots, scrapers) to access PenPage without permission
- Store malicious code, viruses, or harmful content
- Violate others' intellectual property rights
- Use PenPage to harass, abuse, or harm others
- Impersonate others or misrepresent your affiliation
- Overload or interfere with the Service's infrastructure
4. Your Content and Data
4.1 Ownership
You own your content. All notes, text, images, and other content you create
in PenPage belong to you. We claim no ownership rights over your content.
4.2 Your Responsibility
You are solely responsible for:
- The content you create and store in PenPage
- Backing up your important notes (via export or cloud sync)
- Ensuring your content complies with applicable laws
- Any consequences of sharing or exporting your notes
4.3 Data Storage and Backup
Important: Because PenPage stores data locally in your browser by default:
- Clearing browser data will delete your notes
- Uninstalling your browser may delete your notes
- Using browser "incognito/private" mode may prevent saving notes
- We recommend regularly exporting important notes or enabling cloud sync
5. No Account Required
PenPage does not require account creation. However:
- Your notes are tied to your browser and device
- We cannot recover notes if you lose access to your browser/device
- If you enable Google Drive sync, you use your Google account (subject to Google's terms)
6. Google Drive Integration (Optional)
If you choose to enable Google Drive sync:
- You must have a valid Google account
- You grant PenPage permission to read/write files in a dedicated folder on your Google Drive
- You can revoke this permission anytime via Google Account settings
- Google's Terms of Service and Privacy Policy apply to data stored in Google Drive
- We are not responsible for Google Drive service availability or data loss
7. Service Availability
7.1 "As-Is" Service
PenPage is provided "as-is" and "as available." We strive for reliability but:
- We do not guarantee 100% uptime or error-free operation
- The Service may be temporarily unavailable for maintenance or updates
- We may modify, suspend, or discontinue features at any time
7.2 Offline Functionality
Because PenPage works offline, you can continue using it even if our servers are down
(as long as you've previously loaded the app in your browser).
8. Intellectual Property
8.1 PenPage's IP
The PenPage application, design, code, logos, and trademarks are owned by PenPage or
licensed to us. You may not:
- Copy, modify, or distribute PenPage's code (unless open-source license applies)
- Use PenPage's name or logo without permission
- Create derivative works without authorization
8.2 Open Source Components
PenPage uses open-source libraries (React, Tiptap, etc.). Those components are governed
by their respective licenses. See our GitHub repository for full attribution.
8.3 Source Code License
PenPage's source code is available under the GNU Affero General Public License v3 (AGPL-3.0).
This means:
- You may view, modify, and distribute the source code under AGPL terms
- If you modify and deploy PenPage as a service, you must release your modifications under AGPL
- For commercial use without AGPL obligations, commercial licenses are available

9. Privacy and Data Protection
Your privacy is critical to us. Please review our Privacy Policy to
understand how we handle your data. Key points:
- Local-first storage (your notes stay in your browser by default)
- We don't read, analyze, or sell your notes
- Cloud sync is optional and controlled by you
10. Disclaimers and Limitations of Liability
10.1 No Warranties
To the fullest extent permitted by law:
- PenPage is provided WITHOUT WARRANTIES of any kind (express or implied)
- We do NOT warrant that the Service will be error-free or secure
- We do NOT guarantee that your data will never be lost (backup your important notes!)
10.2 Limitation of Liability
To the fullest extent permitted by law:
- PenPage and its creators are NOT liable for any data loss, damages, or losses arising from your use of the Service
- This includes indirect, incidental, consequential, or punitive damages
- If liability cannot be excluded, it is limited to the amount you paid us (which is $0 for free users)
10.3 Your Responsibility
You accept that:
- You use PenPage at your own risk
- You are responsible for backing up critical notes
- We are not liable if browser storage is cleared or lost
11. Indemnification
You agree to indemnify and hold PenPage harmless from any claims, damages, or expenses
arising from:
- Your violation of these Terms
- Your content or use of the Service
- Your violation of any third-party rights
12. Termination
12.1 By You
You can stop using PenPage at any time. To fully "delete your account":
- Clear browser data to remove local notes
- Delete synced files from Google Drive (if applicable)
12.2 By Us
We reserve the right to suspend or terminate access to PenPage if:
- You violate these Terms
- Your use harms the Service or other users
- Required by law
(Note: Because data is stored locally, we cannot delete your notes—you control that.)
13. Changes to Terms
We may update these Terms occasionally. When we do:
- We'll update the "Last Updated" date
- We'll notify users of significant changes via in-app notification
- Continued use after changes means you accept the updated Terms
- If you don't agree, please stop using PenPage
14. Governing Law and Disputes
14.1 Governing Law
These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law provisions.
14.2 Dispute Resolution
If you have a dispute with PenPage:

- Informal resolution: Most issues can be resolved through discussion

15. Miscellaneous
- Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and PenPage
- Severability: If any provision is found invalid, the rest of the Terms remain in effect
- No Waiver: Our failure to enforce a right doesn't waive that right
- Assignment: You cannot transfer these Terms; we may assign them to successors
